Terms of Service

Dehash It

Last updated:

1. Introduction and Acceptance of Terms

Welcome to Dehash It.

These Terms of Service ("Terms") govern your access to and use of the Dehash It website, application programming interfaces (APIs), developer tools, account dashboard, and related services (collectively, the "Services").

By creating an account, accessing our platform, integrating our APIs, or otherwise using the Services, you agree to be bound by these Terms and our Privacy Policy.

If you access or use the Services on behalf of a company, organization, or other legal entity, you represent that you have the authority to bind that entity to these Terms. In such circumstances, references to "you" or "Customer" include that entity.

If you do not agree to these Terms, you must not access or use the Services.

Dehash It ("we," "us," or "our") reserves the right to enforce these Terms to protect the security, integrity, and lawful operation of the platform.

2. Description of Services

Dehash It provides API-based and web-based tools that enable authorized customers to resolve supported identifiers into associated mobile phone numbers and validate supported telephone number information.

The Services are designed to support legitimate business applications, authorized data processing, system integrations, and other lawful operational requirements.

Service capabilities may include:

  • API-based identifier lookup and resolution.
  • Supported mobile phone number validation.
  • Individual and batch processing functionality.
  • API credential management.
  • Usage monitoring and transaction history.
  • Prepaid service credits and billing management.
  • Developer documentation and integration resources.

The availability of individual features may vary depending on account status, technical requirements, operational considerations, and applicable service restrictions.

We may introduce, improve, modify, or discontinue specific features as the platform evolves, subject to applicable law and any contractual commitments.

Service Coverage and Limitations

The Services support designated categories of Kenyan mobile phone numbers and compatible identifier formats as described in our API documentation.

Not all identifiers, telephone number ranges, operators, or data formats are necessarily supported.

A lookup may return no result where an identifier cannot be resolved using the information available to the Services. Such an outcome does not necessarily establish that the underlying telephone number is invalid, inactive, or nonexistent.

Technical specifications, supported formats, response structures, and integration requirements are described in our published API documentation.

3. Account Registration and Responsibilities

To access certain Services, you must create and maintain a registered account.

You agree to provide accurate, current, and complete information during registration and to update such information when reasonably necessary.

You are responsible for:

  • Maintaining the confidentiality of your account credentials and API keys.
  • Restricting access to authorized personnel and applications.
  • Ensuring that activities conducted through your account comply with these Terms.
  • Implementing appropriate security measures within your systems.
  • Promptly notifying us of suspected unauthorized access or credential compromise.

You must not share credentials in a manner that compromises account security or permits unauthorized third-party access.

We may require additional verification where reasonably necessary to protect the platform, prevent fraud, or comply with applicable law.

You remain responsible for activity conducted using your credentials, except to the extent caused by our own breach of applicable obligations or other circumstances for which liability cannot lawfully be excluded.

4. Authorized Use and Acceptable Use Policy

Dehash It is intended for lawful, legitimate, and appropriately authorized use.

You agree to access and use the Services only in compliance with applicable laws, regulations, contractual obligations, and these Terms.

You must not use the Services to:

  • Collect, identify, or process personal information without an appropriate lawful basis.
  • Conduct unauthorized mass enumeration, scraping, or harvesting of telephone numbers.
  • Build or distribute unauthorized personal information directories.
  • Facilitate unsolicited communications, spam, harassment, or unlawful surveillance.
  • Attempt to circumvent service restrictions, access controls, or security mechanisms.
  • Interfere with the availability, integrity, or security of our infrastructure.
  • Resell, redistribute, or commercially exploit the Services without authorization.
  • Use automated systems in ways that materially degrade service performance or violate published usage limits.
  • Engage in fraud, impersonation, unlawful profiling, or other activities that infringe individual rights.
  • Use the Services for any purpose prohibited by applicable law.

We reserve the right to investigate suspected violations and take proportionate action, including restricting API access, suspending accounts, or terminating Services where justified.

Where legally required, we may cooperate with competent regulatory or law enforcement authorities.

5. Data Protection and Regulatory Compliance

Dehash It recognizes the importance of responsible personal data processing.

Dehash It is registered with Kenya's Office of the Data Protection Commissioner (ODPC) as both a Data Controller and a Data Processor, in accordance with the Data Protection Act, 2019, and applicable regulations.

Depending on the nature of a processing activity, Dehash It may act as a Data Controller or as a Data Processor on behalf of a customer.

Customers remain responsible for ensuring that personal information submitted to, obtained from, or otherwise processed using the Services is handled lawfully.

This includes establishing an appropriate lawful basis, providing required notices, respecting applicable data subject rights, and implementing suitable technical and organizational safeguards.

Where required, the parties may enter into a separate data processing agreement governing their respective responsibilities.

Our registration with the ODPC does not constitute an endorsement or authorization of every use case undertaken by customers.

Additional information about our handling of personal data is provided in our Privacy Policy.

6. API Access and Integration

Access to our APIs is provided through credentials issued to authorized accounts.

API keys are confidential and must be protected against unauthorized disclosure or misuse.

You are responsible for integrating the Services securely and ensuring that your applications comply with published technical requirements.

We may implement reasonable technical safeguards, request limits, authentication requirements, and other operational controls to protect the reliability and security of the platform.

You agree not to circumvent these controls or attempt to gain access to systems, information, or functionality beyond your authorization.

We may update API documentation, introduce new versions, or retire outdated functionality where reasonably necessary for security, compatibility, performance, or continued service development.

Where practicable, we will provide reasonable notice of material changes that may affect existing integrations.

7. Accuracy and Limitations of Results

We endeavor to provide reliable and consistent service results. However, the accuracy, completeness, and availability of information may depend on the characteristics of the submitted identifier and the information available to the platform.

We do not guarantee that every submitted identifier will produce a match.

Where carrier or network attribution information is provided, it may reflect original number allocation information rather than the subscriber's current network.

Mobile number portability, number reassignment, changes in operator allocations, and other telecommunications developments may affect the accuracy of such information.

Customers should not rely exclusively on service results for decisions requiring independently verified subscriber identity, current network ownership, or other information beyond the stated capabilities of the Services.

The Services do not constitute an official subscriber identity verification system or a guarantee of ownership, control, or current use of a particular telephone number.

8. Pricing and Usage-Based Billing

Dehash It operates on a prepaid, usage-based billing model.

Unless otherwise stated in an applicable written agreement or published pricing schedule, successful billable lookups are charged at the prevailing rate displayed on our platform.

The current standard rate is KES 0.10 per successful match.

Charges are applied when a lookup successfully returns a billable result in accordance with the applicable service rules.

Unmatched lookup requests, invalid requests, and requests that fail due to service errors are not charged.

Customers are responsible for monitoring their usage and maintaining sufficient prepaid credit to cover billable transactions.

We may revise our pricing from time to time. Material pricing changes will be communicated through appropriate channels and will apply prospectively, subject to applicable law and contractual commitments.

Charges already incurred before a pricing change will not be retroactively recalculated solely because of that change.

9. Prepaid Wallet and Payments

Customers may fund their accounts through supported payment methods, including M-Pesa.

Payments are credited to the customer's prepaid service balance following successful transaction verification.

Wallet balances represent prepaid credit for eligible Dehash It services. They do not constitute a bank deposit, electronic money account, investment product, or interest-bearing financial instrument.

Prepaid credits may only be used for supported Services, subject to applicable account conditions.

Wallet balances are not transferable between accounts unless expressly authorized by Dehash It.

Payment Verification

A payment is considered successfully completed for service-credit purposes when the relevant transaction has been verified and recorded by the platform.

Processing delays may occur due to payment-provider availability, transaction verification requirements, or other operational circumstances.

Customers should contact support if a payment has been completed but the corresponding credit has not appeared in their account.

Billing Disputes

If you believe a transaction or usage charge is incorrect, you should contact our support team with sufficient information to identify the disputed activity.

We will review billing disputes in good faith and make appropriate corrections where an error is verified.

Refunds and Unused Balances

Unused service credits are generally intended for future consumption of eligible Services and are non-transferable.

Refund requests, including those arising from duplicate payments, erroneous credits, account closure, or service discontinuation, will be assessed in accordance with applicable law, the circumstances of the transaction, and any relevant contractual obligations.

Nothing in these Terms excludes a refund or other remedy that is required by applicable law.

10. Service Availability and Maintenance

We aim to provide a reliable and accessible platform suitable for production integrations.

However, the Services may occasionally experience interruptions, delays, maintenance periods, or reduced functionality due to technical, operational, security, or external circumstances.

We do not guarantee uninterrupted or error-free availability unless expressly provided under a separate written service-level agreement.

We may conduct scheduled or emergency maintenance where reasonably necessary to maintain service security, stability, and performance.

Where practicable, we will provide advance notice of planned maintenance likely to materially affect service availability.

Requests that fail because of service unavailability or internal processing errors are not charged.

Customers are responsible for implementing appropriate error handling, retry policies, and operational safeguards within their integrations.

11. Intellectual Property and Proprietary Technology

Dehash It and its licensors retain all rights, title, and interest in the Services, including associated software, APIs, documentation, trademarks, designs, proprietary technology, and other intellectual property.

Subject to compliance with these Terms, we grant customers a limited, non-exclusive, non-transferable, revocable right to access and use the Services for authorized purposes during the applicable service relationship.

This permission does not transfer ownership of any underlying intellectual property.

Except where expressly permitted by law or authorized in writing, you must not:

  • Copy, reproduce, or redistribute proprietary platform components.
  • Reverse engineer or attempt to extract protected source code or proprietary technology.
  • Circumvent technical protections or access restrictions.
  • Misrepresent ownership of Dehash It technology or services.
  • Use our trademarks or branding in a manner suggesting unauthorized affiliation or endorsement.

Customers retain ownership of information and materials they lawfully submit to the Services, subject to any applicable third-party rights.

12. Confidentiality

Each party agrees to handle confidential information received from the other party with reasonable care and to use such information only for legitimate purposes connected to the Services.

Confidential information may include non-public business information, technical documentation, account credentials, commercial arrangements, and other information that is identified as confidential or would reasonably be understood to be confidential.

Confidentiality obligations do not apply to information that is publicly available through no breach of obligation, independently developed without misuse of confidential information, or lawfully obtained from another source without confidentiality restrictions.

Disclosure may be permitted where required by applicable law or a binding legal process.

13. Suspension and Termination

We may suspend, restrict, or terminate access to the Services where reasonably necessary to:

  • Address material violations of these Terms.
  • Prevent suspected fraud, unlawful activity, or security threats.
  • Protect the integrity and availability of the platform.
  • Respond to valid legal or regulatory requirements.
  • Address persistent misuse of APIs or technical infrastructure.

Where appropriate and reasonably practicable, we may provide notice and an opportunity to resolve the issue before taking action.

Immediate action may be necessary where continued access presents a significant security, legal, or operational risk.

Customers may request account closure through the available account-management processes or by contacting support.

Following termination, access to the Services may cease, and associated information will be handled in accordance with our Privacy Policy and applicable legal obligations.

Any unused prepaid balance will be addressed under the wallet and refund provisions of these Terms and applicable law.

14. Third-Party Services

Certain features of Dehash It may depend on external service providers, including telecommunications, payment, hosting, and infrastructure providers.

These providers operate independently and may be subject to their own terms, technical limitations, and service availability conditions.

We are not responsible for interruptions or failures attributable solely to independent third-party systems except to the extent responsibility arises under applicable law or our contractual commitments.

We may replace or modify third-party integrations where reasonably necessary to maintain or improve the Services.

15. Disclaimers

The Services are provided on an "as available" basis, subject to applicable law and any express contractual commitments.

While we take reasonable measures to maintain accuracy, reliability, and security, we do not warrant that the Services will be uninterrupted, entirely error-free, or suitable for every intended customer use case.

Customers are responsible for evaluating whether the Services meet their particular technical, legal, and operational requirements.

Nothing in these Terms excludes warranties, duties, or protections that cannot lawfully be excluded.

16. Limitation of Liability

To the extent permitted by applicable law, Dehash It will not be liable for indirect, incidental, special, consequential, or purely economic losses arising from use of the Services, including loss of anticipated profits or business opportunities, except where such liability cannot lawfully be excluded.

Our liability for direct losses arising from the Services will be determined in accordance with applicable law and any governing written agreement between the parties.

Nothing in these Terms limits or excludes liability for fraud, willful misconduct, or other matters for which liability cannot lawfully be excluded.

17. Customer Responsibility and Indemnification

You are responsible for your use of the Services and for ensuring that your activities comply with applicable laws and these Terms.

To the extent permitted by law, you agree to indemnify and hold Dehash It harmless against third-party claims, losses, and reasonable expenses arising directly from your unlawful use of the Services, unauthorized processing of personal data, or material violation of these Terms.

This obligation does not apply to the extent that a claim results from Dehash It's own unlawful conduct, negligence, or breach of applicable obligations.

18. Changes to Services and Terms

We may update these Terms to reflect changes in our Services, commercial arrangements, technical capabilities, security requirements, or applicable laws.

Updated Terms will be published on our website with a revised effective date.

Where changes materially affect customer rights or obligations, we will provide reasonable notice where required by law or applicable contractual commitments.

Continued use of the Services after revised Terms become effective may constitute acceptance to the extent permitted by applicable law.

19. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Kenya.

The parties agree to make reasonable efforts to resolve disputes arising from the Services through good-faith discussions before initiating formal legal proceedings, where appropriate.

Subject to applicable law and any mandatory dispute-resolution requirements, disputes that cannot be resolved amicably may be submitted to courts of competent jurisdiction in Kenya.

Nothing in this section restricts rights or remedies that cannot lawfully be waived.

20. General Provisions

Entire Agreement: These Terms, together with the Privacy Policy and any applicable written service agreements, govern your use of the Services.

Severability: If any provision is held invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

No Waiver: Failure to enforce a provision does not constitute a waiver of the right to enforce it later.

Assignment: Customers may not assign their rights or obligations under these Terms without our prior written consent, except where otherwise permitted by applicable law.

Relationship: Nothing in these Terms creates a partnership, employment relationship, joint venture, or agency relationship between Dehash It and its customers.
